Land4Less Clean Title Guarantee
To keep our prices as low as possible, we do not provide title insurance
on our vacant lots. We sometimes have to transfer land by Special Warranty
Deed because most of the available lots in this area were at one time held
by the state. This whole area was sold out by the original developers many
years ago - most owners didn't come because of the lack of local employment
- that's why you can get such great buys today in this beautiful pristine
fresh air place.
The state only transfers land back to the private sector by Special or Limited Warranty Deed, so from that point on the title is commonly transferred in the same manner. However, as of October 1, 2003, new legislation changes the two year period to only 90 days from the date of transfer back to the private sector in which a former owner can challenge the sale from the state to the new buyer. (Act 1215 SB 763)
You can have a title company or an attorney obtain title insurance for you, at your own expense, but we have such confidence that you will not have a problem with our our Special Warranty Deeds that we will replace your lot with another available lot of similar value or refund your money in the highly unlikely event that a previous owner successfully exercises a legal claim on your land.
